£85,000 for back injury carer
Charlene Campbell worked as a care assistant at a local nursing home when she injured her back coming to the assistance of a male resident falling out of bed.
As the resident slid out of bed, Charlene and a colleague tried to stop his fall first by lifting him back into the bed and then by lifting him into his wheelchair.
Charlene, however, had been trained to carry out an improper lift and as a result, she suffered from severe lower back pain due to a slipped disc.
In addition, although hoists were available at the nursing home Charlene had neither been instructed nor trained to use them.
Deciding to bring a claim against the nursing home, Charlene enlisted the help of Daniel Slade at Express Solicitors.
He explains: “The nursing home was both in breach and negligent of its statutory duties which involved giving Charlene proper training and information on how to handle loads correctly; providing information about the weight of the resident; informing her of the risks to her health in attempting to help him and providing an appropriate care plan for the resident.
“We were therefore able to bring a claim for Charlene’s ongoing back pain, loss of earnings and future earnings and also her rehabilitation costs which include pain management treatment, cognitive behavioural therapy, physiotherapy and occupational therapy.
“Charlene was also able to claim for the effect of her injury on her ability to carry out everyday tasks like housework and more importantly her inability to carry on as a care work or to carry out heavy manual tasks.”
Although the nursing home tried to fight Charlene vigorously in her claim, Daniel managed to achieve an offer from them of £85,000, which Charlene was delighted with to help her start to rebuild her life.
“I had always wanted to put the incident behind me and was delighted when Daniel managed to secure £85,000 for me,” said Charlene.
