Pleural plaques “ are you eligible to make a claim?

People suffering from the asbestos-related lung condition pleural plaques in Scotland and Northern Ireland are eligible to claim for compensation, although it is still not possible in England and Wales.

Pleural plaques is the scarring of the pleura, which are the thin layers of tissue that protect and cushion the lungs. It typically develops 20 to 30 years after exposure to asbestos dust and can often lead to a more serious asbestos related lung condition.

Claiming compensation for pleural plaques

It used to be possible for people with pleural plaques to claim for compensation. However, The House of Lords later ruled in Johnson v NEI Combustion that compensation would no longer be paid. It was decided that people could only claim if it developed into a more serious condition such asbestosis or mesothelioma, which is a cancer.

Legislation has changed so that those people suffering asbestos related pleural plaques could claim from October 12, 2011 in Scotland and December 14, 2011 in North Ireland.

In England and Wales, this position has not changed and people are unable to claim compensation if they have developed pleural plaques, however this could change in the future and Express Solicitors is prepared for when it does.
